1. Who these terms are with

This website is operated by ZukaHQ Inc., a corporation incorporated in Delaware, United States and managed from Kampala, Uganda. By using the site you agree to these terms. If you do not agree, please do not use it.

2. The website is informational

The pages here describe the company and the kind of work it does. They are provided for general information. We try to keep them accurate and current, but we do not warrant that every statement is complete or error free, and we may change the content at any time.

3. Nothing here is an offer or a contract

Descriptions of services, approaches, or capabilities are not an offer to contract, a quotation, or a commitment to deliver. Any engagement begins only when scope, fees, timing, ownership, and confidentiality are agreed in a separate signed agreement or written statement of work. Where that agreement conflicts with this page, that agreement governs.

4. Signed-in product areas

Some areas of this domain host product software behind a login and are available only to accounts we have created or approved. Access to those areas is subject to the terms presented at sign-up and may be suspended or withdrawn. Our messaging product is currently paused and is not accepting new businesses, so nothing on this site should be read as an offer of that product.

5. Acceptable use

You agree not to:

• Attempt to gain unauthorised access to any part of the site or its systems
• Probe, scan, or test the vulnerability of the service without written permission
• Interfere with the availability of the service for others
• Scrape or reuse the content in a way that infringes the rights below
• Use the site to break any applicable law

6. Intellectual property

The content, design, text, and code of this website belong to ZukaHQ Inc. or are used with permission, and are protected by applicable law. You may read and share links to the site. You may not copy or adapt substantial parts of it for your own commercial use without written permission. Third-party names and technologies mentioned on the site belong to their respective owners and are referenced descriptively only.

Ownership of work produced in a client engagement is dealt with in that engagement’s agreement.

7. Third-party links and services

The site may link to or depend on services operated by others. We do not control those services and are not responsible for their content, availability, or practices.

8. No warranty

The website is provided on an as is and as available basis, without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the site will be uninterrupted or free of errors.

9. Limitation of liability

To the fullest extent permitted by law, ZukaHQ Inc. will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of your use of this website. Nothing in these terms limits liability that cannot be limited by law. Liability arising from paid work is addressed in the relevant engagement agreement.

11. Changes to these terms

We may update these terms. The date at the top of the page shows when they last changed, and continued use of the site after a change means you accept the updated version.

12. Governing law

These terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of laws rules. Mandatory consumer protections available to you in your country of residence are not affected.
